PUBLIC NOTICE OF FILING OF APPLICATION BY SPECIAL WASTE DISPOSAL, INC. FOR A MAJOR MODIFICATION TO THE SOLID WASTE FACILITY PERMIT FOR THE SPECIAL WASTE DISPOSAL, INC. ASBESTOS MONOFILL
MOUNTAINAIR, TORRANCE COUNTY, NEW MEXICO
Pursuant to Section 22 of the New Mexico Solid Waste Act (Section 74-9-22 NMSA 1978) and 20.9.3.8.G NMAC (New Mexico Solid Waste Rules), notice is hereby given to the public and
other affected individuals and entities that Special Waste Disposal, Inc., owner and operator of the existing Special Waste Disposal, Inc. Asbestos Monofill (Facility ID No. SWM-013035 (SP)), has filed an Application with the Resource Recovery Bureau (formerly Solid Waste Bureau) of the New Mexico Environment Department (NMED) for a Major Modification of its solid waste facility permit. The Application may be reviewed at the NMED address listed in
Section 5 of this Notice and at the administrative offices of the Applicant as listed in Section 1. Pertinent information required by the Act and the Rules is as follows.

2. Anticipated Start-Up Date and Planned Hours of Operation:
The facility is an existing permitted special waste asbestos monofill. Operations under the current permit (SWM-013035 (SP), expiration October 16, 2027) continue. The Major
Modification, if approved, will authorize lateral expansion and additional waste streams.
Operating hours are by appointment, generally Monday through Friday, 7:30 a.m. to 5:30 p.m. The facility may operate outside of scheduled hours to accommodate site preparation, weather conditions, cover application, special projects, infrastructure construction, maintenance, monitoring, and other special circumstances. Construction and placement of
waste in the expansion area is anticipated to begin following NMED approval and completion of any required construction activities, currently projected for calendar year 2027 or as authorized by the permit.
3. Description of the Facility:
a. General Process.
Special Waste Disposal, Inc. operates a dedicated asbestos monofill that receives regulated and non-regulated asbestos waste for disposal. The Major Modification Application requests authorization for a lateral expansion of the facility by approximately 20.5 acres (total permitted
area of approximately 60.5 acres) and the addition of two dedicated trenches within the expansion area: (1) a Construction and Demolition (C&D) trench for mold-contaminated debris, and (2) a Scrap Tire Monofill trench for baled scrap tires. Asbestos waste will continue
to be handled, containerized, and covered in accordance with 20.9.8.12 NMAC. Mold-contaminated debris and baled scrap tires will be managed in segregated trenches under
approved management plans. At the end of each working day, active areas will be covered with a minimum of six (6) inches of soil or an NMED-approved alternative daily cover.
b. Location.
The facility is located at 91 Liberty Valley Road, Mountainair, Torrance County, New Mexico.
The legal description is: Within the N½ of Section 19 and within the NW¼ of Section 20, T.2N., R.8E., NMPM (specifically: NE¼ of the NW¼ of the NE¼ of Section 19, the W½ of the NW¼ and the NE¼ of the NW¼ of Section 20, T.2N., R.8E., NMPM).
c. Size.
The existing permitted facility is approximately 40 acres. The proposed lateral expansion is approximately 20.5 acres, for a total facility area of approximately 60.5 acres within the property boundary.
d. Quantity, Rate, and Type of Waste to be Handled.
The facility will continue to accept regulated and non-regulated asbestos waste. Under the proposed Major Modification, the facility will also accept mold-contaminated construction and demolition debris in a dedicated C&D trench and baled scrap tires in a dedicated scrap tire monofill trench. The anticipated annual disposal volume for the facility (all waste streams combined) is estimated at 10,000 to 20,000 cubic yards per year. Actual volumes will vary based on market demand and generator activity. Waste acceptance will be limited to those waste
types authorized in the approved permit.
e. Description of Proposed Modification.
The proposed Major Modification consists of: (1) lateral expansion of the existing asbestos monofill by approximately 20.5 acres; (2) addition of a dedicated Construction and Demolition trench within the expansion area for mold-contaminated debris (managed under a disposal
management plan pursuant to 20.9.8.18 NMAC); and (3) addition of a dedicated Scrap Tire Monofill trench for baled scrap tires, designed in accordance with 20.9.4.13(D) NMAC
(maximum trench dimensions 15 feet deep × 50 feet wide × 100 feet long, with minimum 40-foot separation between trenches).
4. Procedures for Filing Comments:
Interested persons may submit written comments regarding the Application to the New Mexico Environment Department, Resource Recovery Bureau, at the address listed in Section
5 below. Comments should reference Facility ID SWM-013035 (SP) and the Special Waste Disposal, Inc. Major Modification Application. The Application is subject to public hearing
requirements under the Solid Waste Act and 20.1.4 NMAC. Further information regarding the public hearing process will be provided by NMED upon determination that the Application is administratively complete.

Publication in a newspaper of general circulation in Torrance County, certified mail to required property owners and governmental entities, and posting at the facility entrance and other public places will be performed as required. Where appropriate, notice will also be provided in Spanish.
